How to read the tracker

Regulation (EU) 2023/1114 on markets in crypto-assets (MiCA) cannot be read on its own: its articles call for several dozen implementing measures, adopted at three levels.

  • Level 1: the Regulation itself, adopted by the European Parliament and the Council.
  • Level 2: regulatory technical standards (RTS) and implementing technical standards (ITS), drafted by ESMA or the EBA and adopted by the European Commission as delegated or implementing regulations. They are directly applicable.
  • Level 3: guidelines, Q&As and statements issued by ESMA and the EBA. In France, the AMF incorporates ESMA guidelines into its doctrine through positions; the ACPR declares its compliance with EBA guidelines.

Each row of the tracker corresponds to a mandate, that is, the article of MiCA that provides for the measure. The progress bar follows its five stages: consultation, final report, adoption, publication and application. Expand a row to see each document, its date, its reference and a link to the official source.

Which rules apply to a crypto-asset service provider?

In addition to MiCA, a crypto-asset service provider (CASP) authorised in France must comply with:

  • the travel rule (Regulation (EU) 2023/1113), applicable since 30 December 2024: information on the originator and the beneficiary must accompany every transfer of crypto-assets;
  • anti-money laundering and counter-terrorist financing (AML/CFT) rules, currently set out in the French Monetary and Financial Code and, from 10 July 2027, in Regulation (EU) 2024/1624 (AMLR);
  • Regulation (EU) 2022/2554 on digital operational resilience (DORA), applicable since 17 January 2025;
  • Directive (EU) 2023/2226 (DAC8): reporting crypto-asset service providers collect information on their users and on transactions carried out since 1 January 2026, with a first report due to the French tax authorities by 15 June 2027;
  • French law: Ordinances No 2024-936 and No 2024-937 of 15 October 2024, their implementing decrees, the AMF General Regulation and AMF doctrine, and ACPR publications for issuers of e-money tokens and asset-referenced tokens.

The transitional period ended on 1 July 2026. A provider that does not hold a MiCA authorisation, granted by the AMF or by the competent authority of another Member State, may no longer provide crypto-asset services in France.

Frequently asked questions

A regulatory technical standard. ESMA or the EBA drafts it and submits it to public consultation; the European Commission then adopts it as a delegated regulation. Once published in the Official Journal of the European Union, it is directly applicable, without transposition, from the date it specifies.

They are not regulations. However, national competent authorities must state whether they comply with them, and providers must make every effort to comply. The AMF incorporates them into its doctrine through positions and applies them in its supervision: in practice, a CASP authorised in France must follow them.

An automated watch checks the official sources every day. The firm reviews each new text before it goes online. The date of the latest update appears at the top of the tracker.
